Re: Public Records Request — Asheville Stadium District Development
    Funding Sources and Federal Participation
Dear FOIA Officer:

Pursuant to the North Carolina Public Records Act (N.C. Gen. Stat. § 132-1 et seq.), I respectfully request copies of the following records related to the proposed Asheville Stadium District Real Estate Project on the UNC Asheville campus:

  1. Funding source documentation. All documents identifying the sources of the $29 million in public subsidies sought for the Asheville Stadium District Real Estate Project, including but not limited to:
    1. Applications for state funding
    2. Applications for federal funding (including CDBG, CDBG-DR, EDA, HUD, DOT, or any other federal program)
    3. Communications with state or federal agencies regarding funding for this project
    4. Budget projections identifying funding sources by category (state, federal, local, private)
  2. Feasibility study and economic analysis. The feasibility study or economic analysis referenced by Chancellor Kimberly van Noort in public statements regarding the stadium project, including any market studies, financial projections, or pro forma analyses prepared by or for UNC Asheville, McCullers Group, HR&A Advisors, or any other party.
  3. Ground lease. The complete executed 99-year ground lease between UNC Asheville and Asheville Stadium District Real Estate Project LLC, including all exhibits, amendments, and side agreements.
  4. Pre-formation communications. All records of communication between UNC Asheville and the McCullers Group / Asheville Stadium District Real Estate Project LLC prior to the LLC's registration on November 27, 2024.
  5. Boundary survey. The $87,700 Millennial Campus boundary survey and its results.
Section 106 Flag — Federal Funding Nexus: If any federal funding source is identified in responsive documents, please note that this may trigger mandatory consultation requirements under Section 106 of the National Historic Preservation Act (54 U.S.C. § 306108), given the documented archaeological resources on the site (Von Ruck site, 1989 Hall & Baker survey) and the ancestral Cherokee significance of the area (Togiyasdi). Federal undertakings affecting historic properties require consultation with the State Historic Preservation Office (NC SHPO) and affected tribal nations, including the Eastern Band of Cherokee Indians, before construction may proceed.

Purpose: This request is made for purposes of public interest research into the environmental, fiscal, and governance implications of the proposed development on UNC Asheville's 45-acre campus forest. The research is non-commercial and aims to inform public deliberation on the Millennial Campus Development Commission process.

Fee waiver request: I respectfully request that fees be waived, as this request is made in the public interest and not for commercial purposes, consistent with N.C. Gen. Stat. § 132-6.2(b). If fees are assessed, please notify me before proceeding if the total will exceed $50.00.

Response timeline: The North Carolina Public Records Act requires that records be provided “as promptly as possible.” North Carolina courts have held that a response within two to three weeks is generally reasonable. I respectfully request acknowledgment of receipt within five business days.

If any responsive records are withheld, I request identification of the specific statutory exemption relied upon for each withheld document, as required under the Act.
